By using a Privileges Card membership or associated website or Digital Card, you agree to the following terms.
Independent Venues
Privileges provides access to promotional offers from participating restaurants, cafés and other venues. Each venue is an independent business and is solely responsible for its operations, staff, pricing, food and beverage preparation, service standards and compliance with all applicable laws. Privileges does not prepare or supply any food or beverages and accepts no responsibility for the conduct, products or services of any venue.
Accuracy of Information
While we take reasonable care to ensure that venue information and offers are accurate, Privileges, its agents and corporate clients do not warrant that all information is error-free and accept no liability for errors or omissions.
Availability of Offers and Venues
Participating venues, offers and discounts may change, be withdrawn or be unavailable at any time without notice. A venue’s participation is not guaranteed for any minimum period. The most current list of participating venues and offers will be published on our official website. We reserve the right to remove or suspend any venue or amend any offer at our discretion.
Digital Card and Website Access
We do not guarantee uninterrupted access to the Digital Card or website. Privileges is not liable where the Card cannot be used due to ISP, server, website, software, hardware or connectivity issues beyond our reasonable control.
Refused Offers
If a valid offer is refused without reasonable cause, we will provide a goodwill benefit equal to 110% of the saving that should have been received, provided the Cardholder follows our published claims process.
Limitation of Liability
To the maximum extent permitted by law, the total liability of Privileges to you is limited to the amount paid for your membership. Nothing in these terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law.
Misuse
Privileges reserves the right to suspend or cancel a membership where there is misuse of the Card, fraudulent conduct, or breach of these terms.
Third-Party Statements
Privileges is not responsible for any representations or statements made by venues or other third parties.
Governing Law
These terms are governed by the laws of the Australian Capital Territory. Any disputes will be subject to the jurisdiction of the courts of the ACT.
Amendments
We may amend these terms from time to time by updating them on our website. Continued use of the Card constitutes acceptance of the updated terms.
